1. Trademark Search
We recommend the first step is to undertake a search of Australian records to ascertain if there are any potential conflicts with your proposed trademark. We undertake a comprehensive search and with each search we do, we include a concise and easy to understand report, outlining any risks you face and detailing the best approach for moving forward. The results of the search report will allow us to tailor your trademark application to ensure the best possible chance of your trade mark proceeding without obstacle.
2. Trademark Lodgement
Once you are ready to lodge your trademark, we work with you to ensure the best possible coverage for the goods and services you deliver to your customers. Trademarks can be registered in one or more of 45 different classes (categories) of goods and services and we provide you with a list that you can pcik the relevant classes from.
The Australian Trade Mark Office requires a number of formalities to be fulfilled before they will accept an application for a trademark in Australia. We ensure all formalities are fulfilled and the application will proceed without any delays.
3. Trademark Examination
Once the application is filed the Australian Trademarks Office undertakes an ‘examination’ process, where they will report any formality problems or other objections such as similar trade marks, a prohibited sign included in the application or the trademark is not distinctive.
If there are any problems the Trade Mark Office will provide a written report outlining the objections. If we have completed a search on your behalf (see 1 above), we should be aware of any potential problems.
The entire trademark process in Australia will take at least 7 months where the application proceeds smoothly. Any formality problems or objections raised can significantly delay the process.
4. Trademark Registration
Once the examination phase is complete the Trade Mark Office can then be accepted and your application will be advertised in the official Trade Marks Journal to allow third parties the opportunity to oppose it.
After advertisement we can register your trademark for an initial period of 10 years and we will supply the official Certificate of Registration to you.
A trademark in Australia gives you rights through out the whole of Australia and there is no need to register in each individual State.
