TRADEMARK INFRINGEMENT

Infringement of a registered trademark occurs where another party, without the consent of the owner uses a mark the same or similar to that registered trademark. Preliminary investigations may be required to ascertain any use or the extend of use by another party. We can conduct investigations on your behalf. Once illegal activity has been verified, we can act on your behalf to resolve the matter. In many instances we are able to settle the matter before court proceedings are required, providing a simpler and cheaper alternative for our clients. However, on occasion court proceedings are required and we can manage this process on your behalf.

We have extensive experience in dealing with infringement matters. If you find another party using a mark that is the same or similar to your trade mark you should take action as soon as possible. The sooner you take action, the better chance of success you should have.

To ensure you protect your trade mark, we offer a trademark marketplace monitoring service where we will notify you of any potential infringement to your trade mark. We will monitor the Australian marketplace on your behalf  Our monitoring service will ensure you are protecting your trademark, which is your asset. For more information see our trademark management page.

Where ever in the world infringement occurs, we can assist you to protect your rights.
