One country, or the whole world

There are three ways we can seek international trademark protection:

1. A single ‘global’ trade mark application (100+ countries)

2. A trade mark application to cover the EU (27 countries)

3. Individual country trade mark applications

1. More bang for your buck – the Madrid Protocol trade mark application

An international agreement known as the Madrid Protocol allows you to obtain trade mark registration in over 100 countries via a single application. First your trade mark needs to be filed in Australia – only then is it eligible for filing via the Madrid Protocol.

MacMillan Trade Marks can make this single trade mark application for you. Our expertise ensures your application runs as smoothly as possible – meeting all requirements to avoid delays and maximise the chances of successful protection of your brand internationally.

Who’s included?

Australia has been a member of the Madrid Protocol since July 2001. Other member countries include the following – though this is not a complete list:

  • United States of America
  • Canada
  • European Union
  • United Kingdom
  • China
  • Japan
  • Singapore
  • Philippines
  • India
  • New Zealand
  • Mexico
  • Malaysia
  • Switzerland
  • Thailand

2. Trade mark protection in the European Union

If you need trade mark coverage across the EU, we can register a European Union trade mark. This single application provides protection in all 27 member countries.

An address for service is required in all countries, as part of the application, which we provide without additional cost.

3. Individual trade mark protection in other countries

International trade mark protection can also be obtained by filing with individual countries. This is necessary for those countries that are not members of the ‘Madrid Protocol, such as Canada.

In this case, an application must be made to each country you are seeking a trade mark.

MacMillan Trade Marks have associate attorneys in each country to make sure the trade mark application is filed in accordance with the laws of that country and the application proceeds without delay.
